Ministry of Justice planning e-auctions for forced sales of property

An electronic auction would secure a transparent procedure of a forced sale of property and the availability of information to everyone who wants to take part in the procedure, Minister of Justice Nela Kuburovic told Tanjug, announcing other amendments to the law as well.
Kuburovic pointed out that it was the forced sale of property that was the cause of numerous complaints by citizens, so it is expected for e-auctions to ensure more transparent and just procedures of sale of property.
Electronic sale also helps avoid the possibility of agreement between the participants in an auction, whereby larger amounts are reached in property sales, while at the same time protecting the interests of creditors. The Work Group for the preparation of amendments has already been formed, consisting of representatives of the judiciary and public prosecutor’s offices, the economy, foreign investor councils, AmCham, NALED and legal practitioners.
Kuburovic noted that enforcement officers from the territories covered by all four appellate courts in Serbia (Belgrade, Novi Sad, Nis and Kragujevac) also took part in the work group, as the practice shows that enforcement officers act differently in different jurisdictions.
The task of the work group is to remove all the vague points noticed in the implementation of the law and equalize the enforcement and court procedures. Kuburovic says that the law from 2016 has managed to raise the efficiency of enforcement and contribute to a great reduction in the number of old cases, but that certain shortcomings have been noted as well.
When it comes to legislative activities of the Ministry of Justice, Kuburovic announces plenty of activity in the autumn, as several long awaited laws are to be put on the National Assembly agenda. Primarily, this pertains to the Law on Prevention of Corruption, regulating the activities of the Anti-Corruption Agency, the Law on Protection of Personal Data and the Law on Lobbying.
– This way, we are fulfilling our obligations from the Action Plan for Chapter 23 and anti-corruption measures, which pertain to the strengthening of prevention in countering corruption – the minister pointed out.
